1. Agreement to These Terms
These Terms and Conditions (these “Terms”) are a binding agreement between you and Ignem Feram LLC, a Georgia limited liability company doing business as Bear the Fire (“Bear the Fire,” “we,” “us,” or “our”). They govern your use of bearthefire.com (the “Site”), our member portal (hosted on the Kajabi platform), our four-year rite of passage and its materials (the “Rite”), our year-by-year purchases of the Rite, and any physical merchandise we provide (together, the “Services”).
By accessing the Site, creating an account, or making a purchase, you agree to these Terms and to our Privacy Policy and Cookie Policy, which are incorporated by reference. If you do not agree, do not use the Services.
2. Eligibility
The Services are intended for adults. You must be at least 18 years old and legally capable of entering a binding contract to use the Services. The Services are operated from the United States and are directed to a U.S. audience. You may access and purchase the Services from outside the United States on your own initiative, but you are responsible for compliance with your local laws, we make no representation that the Services are appropriate or available in other countries, and we ship physical merchandise only to U.S. addresses.
3. Your Account
Member accounts are created and managed through our member portal, which is hosted by Kajabi. You agree to provide accurate and current information, keep your login credentials confidential, and notify us promptly of any unauthorized use of your account. You are responsible for all activity under your account. Accounts are for one person only and may not be shared, and access to member content may not be given to others.
4. Purchases and Billing
Pricing. All prices are in U.S. dollars and are shown at checkout, along with any applicable taxes or shipping charges.
Year-by-year purchases; no automatic renewal. Bear the Fire is a multi-year rite of passage, and each year of the Rite is a separate one-time purchase with its own fee. Nothing renews automatically, and we will never charge a payment method on file without your action. As a year of the Rite nears its end, we may invite you by email to purchase the next year. Each year you purchase is unlocked for you to keep, as described in Section 7.
Payment processing. Payments are processed by third-party payment processors (such as Stripe, Kajabi Payments, and PayPal) through our platform provider. We do not store your full card number.
Price changes. We may change the fee for future years of the Rite at any time. The current fee is always shown at checkout, and a price change never affects a year you have already purchased.
Payment completion. A year of the Rite is unlocked when your payment for it is completed. A failed or incomplete payment simply means the purchase did not go through; it does not affect your access to years you have already purchased.
5. No Ongoing Obligation
Purchasing a year of the Rite does not obligate you to purchase any future year. There is nothing to cancel and no subscription to manage: if you do not wish to continue, simply do not purchase the next year. You keep access to every year you have purchased (see Section 7). Except as provided in Section 6, fees already paid are not refundable.
6. Refund Policy and Welcome Merchandise
7-day refund window
If you are not satisfied, you may request a full refund of any year of the Rite by emailing info@bearthefire.com within 7 days of the date of that purchase. If you request a refund within this window, we will refund the full amount of that purchase and your access to that year's member content will end. Refund requests made after this 7-day window will not be honored, and after the window closes the purchase is final.
Welcome merchandise and shipping timing
Your first-year purchase includes physical welcome merchandise. You receive access to member content immediately upon purchase; your welcome merchandise ships after the 7-day refund window has closed. This keeps the refund process simple — if you request a refund within the window, nothing has shipped and there is nothing for you to return.
If for any reason merchandise has already shipped when a timely refund is requested, the refund is conditioned on returning the merchandise unused and in its original condition, at your expense, following the return instructions we provide; if it is not returned, or is returned used or damaged, we may deduct the retail value of the merchandise from your refund.
Shipping, damage, and loss
We ship merchandise to U.S. addresses only. If we agree, in our sole discretion, to ship merchandise outside the United States, you are responsible for all international shipping charges and for any customs duties, import taxes, or brokerage fees imposed by your country, and delivery times are not guaranteed. You are responsible for providing an accurate shipping address. If your merchandise arrives damaged or defective, or does not arrive, contact us at info@bearthefire.com within 14 days of the expected delivery and we will replace it at no cost to you.
7. Intellectual Property and License
All content in the Services — including the Bear the Fire materials, guides, inventories, lessons, documents, emails, videos, audio, graphics, trademarks, and the structure and organization of the Rite — is owned by Ignem Feram LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws.
When you purchase a year of the Rite, that year is unlocked for you to keep. Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable license to access and use the member content for each year you have purchased, for your own personal, non-commercial use, including use within your own household — for example, walking each of your sons through a year you have unlocked. This license continues even if you do not purchase later years; we may revoke it only if you materially breach these Terms. Purchased content is delivered through our member portal; if we ever discontinue the portal, we will make reasonable efforts to give you continued access to the years you have purchased (for example, through downloadable copies). Any use beyond personal and household use — including use with a small group, class, church, ministry, or other organization — requires our prior written permission or a separate license from us. You may not copy, reproduce, distribute, publish, sell, sublicense, publicly display, create derivative works from, or commercially exploit any content from the Services, and you may not use the content to create or deliver a competing program, without our prior written permission.
8. Acceptable Use
You agree not to:
Share your account or make member content available to anyone who has not purchased access.
Use the Services for any unlawful purpose or in violation of these Terms.
Copy, scrape, download in bulk, or archive content from the Services except where a download is expressly provided.
Interfere with or disrupt the Site, the member portal, or the servers and networks that support them, or attempt to gain unauthorized access to any part of the Services.
Impersonate any person or misrepresent your affiliation with any person or entity.
9. Feedback
If you send us ideas, suggestions, or feedback about the Services, you grant us the right to use them without restriction or compensation to you.
10. Important Disclaimer — Not Professional Advice
Bear the Fire provides educational and personal-development content about fatherhood, character, and family leadership. The Services are not medical, mental-health, psychological, legal, or financial advice, and they are not therapy, counseling, or a substitute for professional care. Always seek the advice of a qualified professional for questions about your health, your family’s wellbeing, or your legal or financial circumstances. Your results from the Rite depend on your own circumstances and effort, and we make no guarantees about outcomes.
11. Disclaimer of Warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IGNEM FERAM LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, OR DATA, ARISING OUT OF OR RELATED TO THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR (B) $100. SOME STATES DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
13. Indemnification
You agree to indemnify and hold harmless Ignem Feram LLC and its members, managers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services in violation of these Terms or of applicable law.
14. Third-Party Services
Portions of the Services are operated by third parties, including Kajabi (website platform, member portal, and checkout) and our payment processors. Your use of those services may also be subject to their own terms and policies, and we are not responsible for the acts or omissions of third-party providers.
15. Termination
If you materially violate these Terms, we may suspend or terminate your account and revoke your license to the content, with or without notice. Sections that by their nature should survive termination (including Sections 7 and 9 through 18) will survive.
16. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules. Before filing any claim, you agree to first contact us at info@bearthefire.com with a description of the dispute and give us 30 days to work toward an informal resolution. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in the State of Georgia, and you consent to the jurisdiction of those courts. To the extent permitted by law, each party waives the right to participate in a class action, and disputes may be brought only on an individual basis. If any part of this section is found unenforceable, the remainder will remain in effect.
17. Changes to These Terms
We may update these Terms from time to time. When we do, we will post the updated version on the Site and revise the “Last Updated” date above, and for material changes we will provide advance notice by email or through the Services. Changes to fees will apply only to purchases made after the notice. Your continued use of the Services after changes take effect means you accept the updated Terms.
18. General
These Terms, together with the Privacy Policy and Cookie Policy, are the entire agreement between you and us regarding the Services. If any provision is found unenforceable, the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for delays or failures caused by events beyond our reasonable control.
